What to know
- Food or beverage facilities in the City of Los Angeles may only provide disposable foodware accessories when requested by the customer according to Ordinances 187028 (2019) and 187030 (2021).
- Disposable foodware accessories include: utensils, straws, napkins, condiment packets, cup lids, beverage trays, etc.
- Remember to only take what you need and bring your own reusable utensils and straws when possible.
Why This Matters
Many disposable foodware accessories are not recyclable or compostable in the City and are frequently littered in our streets, waterways, and neighborhoods. The City encourages customers to only take what you need or bring your own utensils and straws.
What the Ordinance Requires
Ordinances 187028 and 187030 prohibit food or beverage facilities in the City of Los Angeles (City) from providing disposable foodware accessories to dine-in, drive-thru, take-out or delivery customers except upon customer request.
Disposable foodware accessories include, but is not limited to, utensils, condiment packets, disposable plastic drinking straws and all other disposable straws, stirrers, splash sticks, cocktail sticks, toothpicks, napkins, wet-wipes, cup lids, cup sleeves, and beverage trays.
Furthermore, food and beverage facilities with an online ordering platform or using a third-party food delivery service with an online ordering platform must identify the available disposable foodware accessories that customers may request to include in the order and only provide the items the customers selected in their order.
These requirements have been adopted statewide through California Assembly Bill (AB) 1276 in 2021.
